By downloading, installing, or using the Waste Space mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Waste Space ("Company," "we," "us," or "our").
If you do not agree to these Terms, do not use the App. Your continued use of the App constitutes acceptance of any updates to these Terms.
2. Eligibility
To use Waste Space, you must:
Be at least 18 years of age
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the App under applicable laws
Provide accurate and complete registration information
If you are using the App on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. User Accounts
Account Creation
To access certain features, you must create an account. You agree to:
Provide accurate, current, and complete information
Maintain and update your information as needed
Keep your password confidential and secure
Notify us immediately of any unauthorized access
Account Types
Dumpster Owners: List dumpsters for rental, manage bookings, set pricing
Renters: Search and book dumpsters, schedule pickups
Haulers: Provide waste collection and transportation services
Account Responsibility
You are solely responsible for all activities under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
4. Services Description
Waste Space is a platform that connects:
Dumpster owners who want to rent out their dumpsters
Users who need temporary dumpster rental services
Haulers who provide waste collection and transportation
Platform Role: Waste Space is a marketplace platform only. We do not own dumpsters, provide hauling services, or directly participate in transactions between users. We facilitate connections but are not a party to agreements between users.
5. User Conduct
You Agree To:
Use the App only for lawful purposes
Provide accurate information in listings and profiles
Communicate respectfully with other users
Honor bookings and commitments made through the App
Comply with all applicable local, state, and federal laws
Follow proper waste disposal regulations
You Agree NOT To:
Post false, misleading, or fraudulent information
Harass, threaten, or abuse other users
Use the App for illegal waste disposal
Dispose of hazardous materials without proper authorization
Circumvent fees or manipulate the platform
Create multiple accounts to abuse promotions
Scrape, copy, or misuse App data or content
Interfere with the App's operation or security
Use automated bots or scripts
Attempt to reverse engineer the App
Prohibited Materials: Users must NOT dispose of hazardous waste, medical waste, radioactive materials, explosives, or any materials prohibited by law without proper licensing and permits.
6. Payments & Fees
Payment Processing
Payments are processed through PayPal. By making payments, you agree to PayPal's terms of service.
Service Fees
Waste Space charges a service fee on transactions
Fee amounts are displayed before booking confirmation
Owners receive payment minus applicable fees
Pricing
Dumpster owners set their own rental prices
Prices must be accurate and not misleading
All applicable taxes are the responsibility of users
Refunds
Refund eligibility depends on:
Cancellation timing (see Cancellation Policy)
Service completion status
Dispute resolution outcomes
7. Bookings & Cancellations
Booking Process
Renter submits a booking request
Owner accepts or declines the request
Payment is processed upon acceptance
Booking is confirmed and both parties are notified
Cancellation Policy
Renter Cancellations:
More than 48 hours before scheduled pickup: Full refund
24-48 hours before: 50% refund
Less than 24 hours: No refund
Owner Cancellations:
Owners who cancel repeatedly may face account restrictions
Renters receive full refunds for owner cancellations
No-Shows
Users who repeatedly fail to honor bookings may have their accounts suspended or terminated.
8. User Content
Content You Provide
You retain ownership of content you submit (photos, descriptions, reviews). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content on the platform.
Content Standards
Content must NOT:
Infringe on intellectual property rights
Contain illegal, defamatory, or obscene material
Include personal information of others without consent
Contain malware, viruses, or harmful code
Be spam or unauthorized advertising
Content Removal
We reserve the right to remove any content that violates these Terms without notice.
9. Intellectual Property
The App, including its design, features, code, and branding, is owned by Waste Space and protected by intellectual property laws.
The Waste Space name, logo, and trademarks are our property
You may not copy, modify, or distribute App materials without permission
User feedback may be used to improve the App without compensation
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant that:
The App will be uninterrupted or error-free
Defects will be corrected
The App is free of viruses or harmful components
Information on the App is accurate or complete
We do not endorse, guarantee, or assume responsibility for:
The quality of dumpsters or services provided by users
The accuracy of user profiles or listings
The behavior or reliability of other users
Transactions between users
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WASTE SPACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
This includes but is not limited to:
Property damage or personal injury
Lost profits or business opportunities
Data loss or corruption
Disputes between users
Our total liability for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Waste Space, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your content posted on the App
Transactions with other users
13. Termination
By You
You may delete your account at any time through the App settings. Upon deletion:
Your profile and listings will be removed
Active bookings may need to be completed or cancelled
Some data may be retained for legal compliance
By Us
We may suspend or terminate your account if you:
Violate these Terms
Engage in fraudulent activity
Receive multiple complaints from other users
Fail to pay fees owed
Effect of Termination
Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.
14. Dispute Resolution
Between Users
Disputes between users should be resolved directly. While we may offer mediation assistance, we are not obligated to resolve user disputes.
With Waste Space
For disputes with Waste Space:
Informal Resolution: Contact us first to attempt resolution
Mediation: If informal resolution fails, parties may agree to mediation
Arbitration: Disputes not resolved through mediation may be submitted to binding arbitration
Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class arbitrations.
Governing Law
These Terms are governed by the laws of the jurisdiction where Waste Space is incorporated, without regard to conflict of law principles.
15. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by:
Posting updated Terms in the App
Updating the "Last Updated" date
Sending notifications for significant changes
Your continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the App and delete your account.
